Terms of Service

Please read these Terms of Service ("Terms") carefully before using Secret Diary: Private Journal ("the App"). By using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using Secret Diary: Private Journal, you agree to these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Secret Diary: Private Journal is a personal journaling application that allows you to:

• Create daily journal entries with photos and text
• Track your mood over time
• View your entries in calendar and timeline formats
• Export your data in various formats
• Sync data across devices using iCloud (optional)

3. Account and Security

You are responsible for:

• Maintaining the security of your device and passcode
• All activities that occur under your account
• Keeping your backup passcode secure if you set one

4. Subscriptions and Payments

Secret Diary: Private Journal is a premium app. After onboarding, an active Premium subscription, an eligible free trial, or the one-time lifetime purchase is required to access the journaling features. There is no ad-supported free tier, and the app does not display advertising.

Premium Subscription

• Premium is available as monthly, yearly, or lifetime purchase options shown in the app and on the App Store for your region
• Payment is charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless cancelled at least 24 hours before the end of the current period
• You can manage subscriptions in your Apple ID Account Settings

Free Trial

If a free trial is available for your selected plan and Apple ID, the app will show the trial duration and renewal terms before purchase. Trials convert to paid subscriptions unless cancelled before the trial ends.

5. User Content

You retain all rights to your journal entries, photos, and other content you create in the App. We do not claim ownership of your content.

You are responsible for the content you create and store in the App. You agree not to use the App for:

• Illegal activities
• Storing content that violates others' rights
• Any purpose that violates these Terms

6. Data and Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as described in our Privacy Policy.

7. Intellectual Property

The App, including its design, features, and content (excluding user content), is owned by DuttLabs and is protected by copyright, trademark, and other intellectual property laws.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

10. Data Loss

While we design the App to be reliable, we are not responsible for any loss of data. We recommend:

• Regularly exporting your journal entries
• Enabling iCloud sync for backup
• Keeping copies of important entries

11. Termination

You may stop using the App at any time by deleting it from your device. Premium access is managed by Apple. We may terminate or suspend access to any service component we operate if needed to address abuse, fraud, or legal obligations.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes through the App or by other means. Your continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.
